Priority and Confirmations

On the day of a design’s lawful application the applicant obtains her/his right of priority.

Should the applicant be entitled to a right of priority on account of a foreign application this right of priority must be claimed expressly. The date of the foreign application the priority of which is being claimed must be stated as well as the country in which this application was effectuated (declaration of priority). The reference number of the application likewise must be quoted. The declaration of priority must be presented at the Patent Office within two months subsequent to application. Enclosing this declaration with the application form or in the case of multiple design applications, the respective supplementary sheet is, however, recommended.
