We are there for our customers again

and offer advice at the patent office.

At the same time we are still available for you online for all entries and services.

As much as we would like to have personal contact with you, dear customers, at our office (Dresdner Strasse 87, 1200 Vienna) we would like to draw your attention to the fact that we will continue to be available online. This is the safer option in times of a pandemic. You do not have to leave your home or office to take advantage of our advice and services or to submit your documents to us. We also advise you via video telephony (e.g. Skype). Nevertheless, please use - wherever possible - our online input options. You will find all online entry options, arranged according to subject area, at: www.patentamt.at/online-services

You decide - but we would like to point out that you do not have to leave your home or office to receive quality advice from us or to submit your entries to us.

IP Academy

From 13th May, 2020 we offer our seminar content in the form of webinars - that means learning about trademarks, patents and designs from the comfort of your (home) office.

Please register as usual via our website for the respective date. Shortly before the date you will receive a link with which you can register for the webinar. In this virtual setting you will always have the opportunity to ask questions or join in the discussion of a topic.

Your health is important to us

If you decide - despite the well-developed and high-quality online offer for consultation and submission of entries - to come to us personally at Dresdner Strasse 87, 1200 Vienna, the necessary equipment will be available for you on site to protect you from a possible infection. In the customer service centre and during the consultation sessions, you and our staff are protected by a plexiglass wall.

Please note, however, that access to the Patent Office is only permitted with mouth-nose protection.

Entering the customer service centre is only possible individually. In the case of consultations at agreed dates, a maximum of 2 persons and 1 employee are permitted in the Patent Office due to the spatial conditions.

Deadline extension

Legal deadlines ("4. COVID-19-GESETZ")

The statutory time limits laid down in the Patent Act 1970, Protection Certificate Act 1996, Semiconductor Protection Act, Utility Model Act, Patent Agreements Introduction Act, Trademark Protection Act 1970 and Design Protection Act 1990 have been extended as follows

The period from March 16, 2020 to the expiry of April 30, 2020 shall not be included in the period in which a request is to be filed, a declaration made or an act performed.

In contrast to the deadlines for appeal and official deadlines, the beginning of the deadline is not reset, but remains unchanged. The expiration of the deadline is postponed by the time that lies within the period from March 16, 2020 to the expiration of April 30, 2020.

These deadlines are subject to a so-called deadline suspension. Simplified, this means that the deadline stops running (March 16, 2020 up to and including April 30, 2020 = 46 days) and continues after the period of suspension. If only part of a deadline (at the beginning or at the end) falls within the period from March 16, 2020 to April 30, 2020 inclusive, only the part is added.

The aim is to ensure that, as a result, the original deadline is available in full for the assertion of rights.

Attention! There is no extension of

  • Deadlines under the Patent Office Fees Act for the payment of annuity or renewal fees (without prejudice to the possibility of a request for restitutio in integrum into a grace period for the payment of these fees)
  • Time limits due to EU law

Time Limits for appeals ("2. COVID-19-GESETZ")

Time limits for appeals which have not yet expired by March 22, 2020 will also be interrupted until April 30, 2020 in accordance with the Federal Act on Accompanying Measures for COVID-19 in the Judiciary. They will begin to run anew on May 1, 2020 (from the beginning).

Official deadlines ("Patentamts-COVID-19-Verordnung")

All open official time limits still open on March 16, 2020 in proceedings before the Patent Office (e.g. time limits for comments on notices or time limits for the submission of a counter-statement in bilateral proceedings) were interrupted by ordinance until April 30, 2020. They will start anew on May 1, 2020 (in principle from the beginning), although the Patent Office may also set an appropriate new deadline from May 1, 2020.

International trade marks under the Madrid system - notifications by the International Bureau in Geneva

In view of the continuing COVID-related restrictions on postal traffic, the International Bureau of the World Intellectual Property Organization (WIPO) urges applicants and owners of international trademarks under the Madrid system and their representatives to provide an e-mail address for the delivery of notifications concerning these international trademarks.  Such e-mail address can be provided either directly in the request for international registration or directly to Contact Madrid - https://www3.wipo.int/contact/en/madrid/.
