Annual fees

In order to maintain property rights, annual fees must be paid regularly – please note the specific features and details of the individual property rights.

You can conveniently pay the annual fee due via our Online Filing. Simply click on "Create subsequent action", then select the category "Payment of fees" and the request type "Annual/Maintenance Fees". You can pay via eps-transfer, Mastercard or Visa.

Alternatively you can simply pay the annual fee via bank transfer. No form is required for this. Please enter the registration number or file number an "annual fee" in the reference field. Transfer fees are to be paid by the depositor. 

You can check the due date and amount of the annual fee online. To do so, you will need the registration number or file number.

A patent can be protected for a maximum of 20 years.

The annual fees for the coming year are due on the last day of the month that corresponds to the month in which the registration date falls. The annual fees can be paid at the earliest three months before they become due. They must be paid no later than six months after their due date. For each payment made after the due date, a surcharge of 20% of the annual fee must be paid in addition to the annual fee. The surcharge does not apply to the first annual fee payable to the Austrian Patent Office. 

The annual fee for an additional patent is due on the next due date (last day of the month of application) after grant and amounts to 386.00 Euro. Only one annual fee is payable for the entire duration. Additional patents expire at the same time as the parent patent.

The supplementary protection certificate shall take effect upon the expiry of the statutory term of the basic patent. The maximum duration of the certificate is five years which may be extended by a further six months where a paediatric investigation plan has been complied with. The due date for the first annual fee is the last day of the month in which the basic patent expires. The annual fee may be paid no earlier than three months before it falls due and no later than six months after the due date. If payment is made after the due date, the fee shall be subject to a surcharge of 20%. 

A utility model can be protected for a maximum of 10 years.

The annual fees are due for the coming year on the last day of the month that corresponds to the month in which the registration date falls. The surcharge shall not apply to the first renewal fee payable to the Patent Office.

Instead of the individual annual fees, it is also possible to pay flat rates for the 4^th to 6^th year and the 7^th to 10^th year. The due date for the flat rates is based on the due date for the 4^th or the 7^th annual fee.
