Application fees are charged for the filing of inventions, trademarks, and designs. You can either pay these fees directly when filing the application, or you will receive a payment slip approximately two weeks after filing your application, including your file number and the payment reference.
Please do not pay any fees in advance when filing a new application!
In addition, flat-rate document fees are due at the start of the process and must be paid along with the application fee. Please note: The flat-rate document fees are due even if the application is withdrawn!

Value-added tax
The fees charged by the Austrian Patent Office are not subject to value-added tax. The document fees, which are levied to cover administrative costs, are remitted in full to the tax office. No additional taxes are incurred.

Fees for invention applications
A deferral is possible if you are destitute or if your invention clearly serves to generate or save energy, or to reduce greenhouse gas emissions. In both cases, the grant of a patent must not appear manifestly futile. In such a case, certain fee payments are deferred until the sixth annual fee becomes due—that is, for approximately five years:
- Search and examination fees
- Claim fee
- Publication fee
Fees that have already been paid, as well as the publication fee, cannot be deferred. Deferral is available only for patent applications—not for utility models. You can submit the Application (available in German only) at any time during the proceedings.
If you are unable to pay, you may also apply for free representation by a patent attorney.

If several separate applications are filed at the same time that relate to a basic product and processed products derived from it, a fee of €208 must be paid for the second and each subsequent application.
If the application is rejected or withdrawn before it is forwarded to the Commission of the European Union, half of the fee will be refunded.
