Payment of renewal fees

You can protect your design for up to 25 years. To do so, you must renew the protection every five years by paying renewal fees on time. The first fee is due in the sixth year and must be paid in advance. The due date for the renewal fee is based on the date of the design application and is due on the last day of the application month.

Renewal fee details

The fee can be paid within one year prior to the end of the term of protection, but also within six months thereafter (grace period). If payment is made during the grace period, the fee increases by 20%.

To renew designs included in a multiple design application, renewal fees must be paid for each design. The designs included in a multiple design application are legally independent after registration. This means that you can renew only individual designs from the application. When paying the renewal fees, you must specify the numbers of the designs for which the term of protection is to be extended. The renewal fees must be paid according to the number of designs being renewed.

Missed a deadline?

Anyone who misses a deadline due to an unforeseen or unavoidable event and suffers a legal disadvantage as a direct result may apply for reinstatement of the deadline. This is possible within two months after the obstacle ceases to exist, but no later than twelve months after the deadline has expired. The application must state the circumstances that prevented meeting the deadline and provide supporting evidence. At the same time as filing the application, the action that should have been taken within the missed deadline must be completed.
