Payment of renewal fees
Trademarks can last indefinitely. However, you must renew the protection every ten years. Upon registration, your trademark is protected for ten years from the filing date. The first renewal fee is due at the end of the tenth year of protection and must be paid in advance. The due date for the renewal fee is based on the date of the trademark application. The Patent Office reminds trademark owners or their representatives of the need for renewal six months before the end of the protection period.
Alternatively, you can also transfer the fee due directly to our account. Please include the registration number or file number in the payment reference, along with the note “renewal fee.”

Trademark renewal fee
The fee may be paid within one year prior to the end of the term of protection, but also within six months afterwards (grace period). If payment is made during the grace period, the fee increases by 20%.

For trademarks registered BEFORE September 1, 2018, the term of protection in effect on that date is calculated differently than under the current system. It does not end ten years (or a multiple thereof) after the filing date of the trademark, but rather ten years (or a multiple thereof) after the last day of the month in which the trademark was registered. Only the subsequent term of protection (and all subsequent ones) is then calculated under the current system starting from the filing date.
This special situation means that the first term of protection calculated under the current system (and only this one) does not last a full ten years. The more time that has elapsed in the registration process between the filing and the registration of the trademark, the greater this one-time reduction is. If it exceeds one year, the renewal fee is reduced as follows:

Missed a deadline?
Anyone who misses a deadline due to an unforeseen or unavoidable event and suffers a legal disadvantage as a direct result may apply for reinstatement of the deadline. This is possible within two months after the obstacle ceases to exist, but no later than twelve months after the deadline has expired. The application must state the circumstances that prevented meeting the deadline and provide supporting evidence. At the same time as filing the application, the action that should have been taken within the missed deadline must be completed.
An application for reinstatement costs €288,-.
